Major E-Discovery Privilege Waiver in Baltimore Federal Court
Over at responsivedocuments.com, I have an excerpt of a Daily Record article on a privilege waiver by inadvertent or negligent document privilege review policies in a federal case in Baltimore. In short, sloppy rules and procedures for preventing an inadvertent release of privileged documents resulted in both the release of such documents and a ruling that the release effected a waiver of privilege, notwithstanding an attempt to allow a "clawback" of privileged material.
Beyond Eastern Avenue - A New Beginning
I have now moved into the District of Columbia, having survived a slew of medical nastiness, one blown tire in a thunderstorm on Northern Parkway in Baltimore, the adventure of finding an open pharmacist to fill prescriptions for steroids and antibiotics at 3 AM in Langley Park, driving a cargo van in miserable weather, etc. I am out sick from the job today; my chest hurts when I breathe but at least now I can take full breaths. Getting one full night's sleep helped a lot.
Comcast will be installing internet service to my apartment tomorrow and thereafter I will be in a much better position to blog routinely.
Update on the Crab
A brief update. My internet access is limited so this will have to be short. I will be signing a lease at Fort Totten Station in northeast DC on Friday for a Saturday move-in. After internet access starts at that apartment, I will resume more regular posting.
Red Maryland, Free State Politics to Merge
Red Maryland and Free State Politics have reached a tentative agreement to merge their blogs to take advantage of efficiencies of scale and to reflect their increasing convergence of political and philosophical perspectives.
Red Maryland leading blogger Mark Newgent and Free State Politics' Editor in Chief Isaac Smith shook hands on the deal today in the upper back room of Chick 'n' Ruth's Delly on Main Street in Annapolis today.
The new blog will be called "Maryland Politics," a name chosen for its creativity and due to the lack of other blogs currently using of that name.

Pillage Idiot presents Taking the Green Line, not the 7 Train, to Flushing posted at Pillage Idiot, saying, "There's nothing that says "GUY" quite like a synchronized flush of the toilets at a new baseball stadium. Why didn't they invite me?" Attila, please never get civilized. It would break my heart if you ever started walking upright, or discovered fire or the wheel.

Global Warming, Local Politics
I have enjoyed the exchanges between Isaac Smith of Free State Politics and Mark Newgent of, inter alia, Red Maryland regarding global warming and the ecological and economic effects of possible policy responses to them.
I do not claim to have the knowledge of either of these gentlemen on the topic, but I will throw out a few thoughts.

Mark Penn Can Suck My Claw
Mark Penn, Chief Strategist for Hillary Clinton's presidential campaign, quoted in MSNBC's First Read, February 13, 2008:
"Could we possibly have a nominee who hasn't won any of the significant states -- outside of Illinois?" Chief Strategist Mark Penn said. "That raises some serious questions about Sen. Obama."
More on Clinton's reckless strategy of ignoring small- and medium-sized states to come. In a Republican primary, such a strategy might have merit since their system is winner-take-all in most cases: win the big ones by 5 points, get marked as "inevitable" and conserve resources for the general election.

Then if he is the candidate of change fighting Washington, why did a majority of the Washington, DC and the government employees in the surrounding suburbs and those pesky lobbyists and their spouses and employees, vote for Barack? You see, I believe that people act in their own interest. So, when the folks who live inside the beltway, vote in large measure for Barack, then maybe he is not what he claims to be.

Why Mark Newgent Is of Good Character
The Main Adversary's Mark Newgent and I don't agree often on politics or probably philosophy generally. But there are certain basic marks of good character and decency that should cut across political lines, most certainly among them the categorical moral imperative to hold Duke University and any of its sports teams in bitter contempt and loathing. Happily, the good Mr. Newgent acquits himself admirably.
